1. Scope

These Terms of Service apply to all orders placed by consumers in the online shop talexomira.com. The shop is operated by:

In these terms, "we", "us" and "our" refer to Gantho UG (haftungsbeschränkt) as the operator of Talexomira. "You" refers to the customer.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Use of the Website

By using our website, you agree to these Terms of Service. You confirm that you are at least 18 years old or that you are using the website with the consent of a parent or legal guardian.

You may not use our website for any unlawful purpose. In particular, you may not transmit false information, upload malicious code, collect personal data of other users, interfere with the security of the website or use automated tools to copy its content.

3. Conclusion of Contract

The product presentations in our shop are not a legally binding offer, but an invitation for you to place an order.

By clicking the order button, you submit a binding offer to purchase the goods in your shopping cart. Before submitting your order, you can review your entries and correct any mistakes at any time.

After receiving your order, we will send you an automatic email confirming its receipt. This confirmation does not yet constitute acceptance of your offer. The contract is concluded when we send you a separate order confirmation or ship the goods.

The contract language is English. We store the contract text and send you your order details by email.

4. Prices

All prices are in euros and include the statutory German VAT. Shipping costs are shown separately in the shopping cart and at checkout. You can find details in our Shipping Policy.

5. Payment

The available payment methods are shown during checkout. Payment is due when you place your order unless the selected payment method provides otherwise.

6. Delivery

We deliver within Germany only. Delivery times and shipping costs are described in our Shipping Policy. If an ordered item is unexpectedly unavailable, we will inform you without delay and refund any payments already made.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Withdrawal

As a consumer, you have a statutory right of withdrawal. Full details, including the model withdrawal form, can be found on our Returns & Refunds page.

9. Warranty

The statutory warranty rights apply. If an item is defective, please contact us at info@talexomira.com. If goods are delivered with obvious transport damage, please report this to us so that we can assert our claims against the carrier. Failing to do so has no effect on your statutory warranty rights.

10. Liability

We are liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or through gross negligence and for claims under the German Product Liability Act.

For slight negligence, we are only liable for the breach of essential contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In such cases, our liability is limited to the foreseeable damage typical for this type of contract.

11. Accuracy of Information

We take great care to present all information in our shop correctly. Nevertheless, product descriptions, images, prices or availability may occasionally contain errors. We reserve the right to correct such errors. Product images may differ slightly from the actual item, for example in colour, depending on your screen settings.

12. Intellectual Property

All content on this website, including texts, images, logos and graphics, belongs to us or our licensors and is protected by copyright. You may not copy, distribute or otherwise use this content without our prior written consent.

13. Reviews and Feedback

If you send us comments, ideas or feedback, you agree that we may use them to improve our shop and products. Your contributions must not violate the rights of third parties or contain unlawful, offensive or misleading content.

14. Links to Third Party Websites

Our website may contain links to websites of third parties. We have no influence on their content and accept no responsibility for it.

15. Personal Data

We process your personal data in accordance with our Privacy Policy.

16. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not remove the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

17. Consumer Dispute Resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

18. Severability

If any provision of these Terms of Service is or becomes invalid, the validity of the remaining provisions remains unaffected. The statutory provisions apply in place of the invalid provision.

19. Changes to These Terms

We may update these Terms of Service from time to time. The version valid at the time of your order applies to that order.
